THUNDER BAY, ONTARIO ~~~~~ March 28, 2022 (LSNews) Morriseau and her Lawyer Chantelle Bryson would like to confirm that the O.P.P. has commenced its investigation of alleged criminal conduct in our complaints to the Ministry of the Attorney General of December 2021 which were referred on to the O.P.P. for its assessment and are based upon the information in our HRTO and prior OCPC complaints as well as complaints of other officers.
All complaints of criminal conduct relate to the subject officer, now Staff Sergeant Dimini, and the alleged cover up of his criminal conduct by the TBPS Chief Sylvie Hauth, TBPS lawyer Holly Walbourne, now Inspector Gordon Snyder and the Board.
Member Morriseau and complainant and other officers have complimented the professional, prepared and compassionate approach of the O.P.P. investigative team, which has arranged for victim and security services when the Board, City, OCPC and the Solicitor General failed to do so.
The parallel OCPC investigation was announced by the Solicitor General on January 22, 2022 in correspondence to us and then OCPC on February 11, 2022. This investigation was also called upon our complaints to OCPC of April 29, 2021 and December 1, 2021. Neither the Solicitor General, OCPC nor the Board called for investigation of any of these matters though aware of the evolving allegations from April 2021 to present.
The OCPC Terms of Reference named Chief Sylvie Hauth, Deputy Chief Ryan Hughes and TBPS legal counsel, Holly Walbourne, as targets of investigation and laid out the allegations of dishonesty and collusion as applicable to each. The Terms of Reference highlight the illegitimate investigations of Member Morriseau by TBPS regarding receipt of the text message information indicating now Staff Sergeant Dimini as the source of the leak of confidential, racialized TBPS information to the Thunder Bay Court House Inside Edition Facebook and Twitter pages, failures in internal investigations and the administration of the TBPS by the Board. Finally, they indicated the ability to add further allegations for investigation to those against the parties named.
Given the extensive complaints of criminal conduct and or misconduct provided to the Solicitor General, OCPC and its external investigator Ian Scott, former head of the SIU, it was our expectation that those were the matters subject of TBPS internal Police Services Act and criminal investigations that were subject of the OCPC investigation
Those allegations by 23 officers, 2 civilians and 4 members of the public include:
- Dealing steroids and cocaine
- Organized crime affiliations
- Stealing or skimming drugs at investigation scenes
- Interference with drug operations and arrests
- Assault Racial Assaults Assault causing bodily harm
- Illegal entry, search, detention and arrests
- Filing false police and investigation reports
- Intimidation, threats, including to a First Nation elder
- Vandalism
- Perjury
- Interference in and obstruction of Justice
It has now become apparent however that those allegations, some of which are subject of the HRTO complaints and all of which are subject of O.P.P. complaints and investigation are not being investigated by the Solicitor General, OCPC or their external investigator, Ian Scott, on their behalf.
All have repeatedly refused to answer our correspondence enquiring as to why these serious matters of workplace and public safety are not being investigated. While OCPC has issued notices of intention to interview to some members of the TBPS, it has not to the complainants.
Further and upon the sole OCPC request to interview Member Morriseau, we issued the standard inquiry as to whether she is the subject of any allegations to be investigated and if so, what the allegations may be. To our shock, the Solicitor General, OCPC and Ian Scott refused to answer. We therefore repeated our inquiry numerous times to no response, at all. We pointed out that basic principles of procedural fairness and natural justice would require them to disclose this information that they had provided to the Chief, Deputy Chief and Holly Walbourne in the Terms of Reference and that the failure to be transparent with Member Morriseau would also constitute discrimination. No response, at all
We also followed up our earlier request for provision of the court sealed Information to Obtain written by Constable Forshaw and used to secure the production order from J.P. Caron on Member Morriseau’s phone on December 1, 2020. OCPC and Ian Scott refused to provide us with a copy despite this information being central to the allegations subject of Member Morriseau’s complaint, highly relevant to the other complaints, and key to the OCPC investigation. Requiring us to obtain this document on our own entails a full court application, incurring significant costs and significant delay in moving forward with the OCPC investigation.
We were not able to meet with OCPC Investigator Ian Scott as planned last week due to Member Morriseau being ill with COVI
Given the continuing retaliatory actions of the Board and City against Member Morriseau and others for raising these complaints, the need for further information from the Solicitor General, OCPC and Ian Scott regarding their investigation, the need to obtain further relevant information through court processes and family needs, Member Morriseau is now taking a brief leave from the Board and related matters until the end of April 2022.
It has been a long year since she first raised her complaint to the Board and OCPC in April 2021, which then escalated with discovery of the illegitimate TBPS and O.P.P. investigations into her accidental knowledge of the text in October 2021 and the list of serious criminal conduct and misconduct allegations of officers, civilians and members of the public from June 2021 - present, without any substantive action taken by the Board, City, OCPC, the Solicitor General and now OCPC investigator, Ian Scott.
Not one of these entities requested any investigations or offered any interim relief to protect her, her family or other complainants and witnesses or even the integrity of the OCPC and O.P.P. investigations in face of the allegations by approximately 30 unrelated individual officers, civilians and members of the public.
Instead, the Board and City have engaged in a series of retaliatory actions against Member Morriseau and complainant officers and civilians, and the Solicitor General, OCPC and Ian Scott seem to be ignoring the continuing crisis in the TBPS and Board while treating Member Morriseau in an adversarial, unfair and discriminatory manner.
During this brief leave from the Board for Member Morriseau to focus on her work and family, we will take steps to obtain the sealed ITO on our own and to uncover why the Solicitor General, OCPC and Ian Scott are ignoring the serious allegations of misconduct and criminal conduct against Staff Sergeant Dimini, Holly Walbourne, the Chief Sylvie Hauth, Inspector Gordon Snyder, and the Board
Member Morriseau will provide an interview to OCPC in person upon her return and once this information as well as any personal allegations are obtained or provided
