FIVE YEAR PRISON SENTENCE FOR FENTANYL DEALER

FIVE YEAR PRISON SENTENCE FOR FENTANYL DEALER

WESTFORT DRUG DEALER

THUNDER BAY, ONTARIO  ~~~~~~ March 16, 2022 (LSNews)  A 26 year old JACOB BYRON FRANTZEN appeared by video from the Central North Correctional Center, Penetanguishene today, Wednesday, March 16,2022 before His Honour, Justice Bob Rogerson to plead guilty to fentanyl trafficking.

ADMITTED FACTS
Thunder Bay Police began an investigation into FRANTZEN in early February of 2021. Officers obtained a tracking warrant for his phone and surveilled his movements.

Hardworking TBPS Officer conducted a traffic stop on a red Dodge Caravan on March 2,2021.

FRANTZEN was sitting in the passenger seat with a plastic bag under his seat. Drugs were found on FRANTZEN and in the bag.

Drugs seized were:

  • -49.97 grams of fentanyl
  • -106.8 grams of crack cocaine
  • -79.1 grams of powder cocaine
  • -4 oxycodone pills

A key for a bedroom at Frederica Street West was on FRANTZEN.

TBPS Officers obtained a search warrant for  Frederica Street West and 808 Alberta Street where another 360 grams of fentanyl was seized along $19705 in cash.

JOINT SUBMISSION
Federal Crown Attorney Misbah Haque & Toronto Defence Attorney Jeff Hershberg have a joint submission for His Honour to consider.

JACOB FRANTZEN is from the Toronto area.  His mother, Melody Frantzen has tuned in to watch her son’s sentencing.

FRANTZEN grew up in a good home with good parents who were strict with him. They never gave him money whenever he asked, so Jacob became a drug dealer.

MELODY FRANTZEN tells the Justice Rogerson about her son “What he’s done is quite stupid”

FRANTZEN has a criminal record and has been convicted previously for drug trafficking. He does not use fentanyl and he was trafficking for financial gain

FRANTZEN has been in custody for a total of 1 year & 15 days. That will be enhanced at a 2:1 ratio (due to poor conditions at the Correctional Center) for a total of 25 months of presentence custody.

A 5 year prison sentence minus 25 months presentence custody is the submission plus a forfeiture of $19705 in cash.

Justice Rogerson accepts the joint submission and tells FRANTZEN that the sentences will only get longer if he’s convicted of selling drugs again. His Honour also states “You are fortunate not to be addicted.

A DNA order is placed along with a weapons prohibition for life. FRANTZEN has 35 months remaining to serve but will be statutorily released in just under 24 months and could be paroled in less than a year.

FRANTZEN tells Justice Rogerson that this has been the hardest year of his life and he won’t be back in court again.

FRANTZEN will be transferred to a Federal Penitentary to serve his time. All remaining charges against FRANTZEN are withdrawn by the Crown.
