$9,000 Fine and ordered to comply with work permit conditions

THUNDER BAY, ON   ----  May 31, 2010 -----  A Winnipeg, Manitoba, resident Ontario Ministry of Natural Resourceshas been fined a total of $9,000 and ordered to comply with the conditions of his work permit after attempting to construct a building illegally

Ian Rentz was fined $1,000 for constructing a building without a work permit. He was also fined $4,000 for continuing construction after receiving a stop work order from the Ministry of Natural Resources and another $4,000 for failing to comply with the terms and conditions of a work permit. He was ordered by the court to comply with the work permit by June 30, 2010.

The court heard that on April 15, 2009, a Ministry of Natural Resources technician inspected Rentz’s cottage property on an island in Echo Bay on Lake of the Woods in Kenora. Rentz was constructing a building without a work permit. He was ordered to stop work until he obtained a work permit. On May 23, 2009, a Ministry of Natural Resources Kenora District conservation officer saw Rentz continuing to work on the structure despite the stop work order and without a permit. A few months later, Rentz received his work permit but failed to comply with its terms and conditions. 

The case was heard before Justice of the Peace Roger McCraw Jr. in the Ontario Court of Justice, Kenora, on May 18, 2010.

The area where Rentz was constructing the cottage is under a Restricted Area Order. The order is intended to ensure that new development on private lands will not damage water quality or lake trout habitat. A work permit is required to erect any building or structure within the restricted area.
